How do I enforce a court order? From what I gather I have to apply back to court? Does it cost me anything?
Basically my ex is not keeping to the full order and not letting me have my child on some of the days I should.
Is there likely to be any penalty for her breaking the order?
Thank you
Hi, yes you need to enforce the order by submitting a C79 application to your family court. If you are on a low income, fill out a Help With Fees form first, save the reference number and put it on the C79 form. Otherwise, if you are not entitled to Help With Fees, it will be £255. Application takes up to 8 weeks from the date it was submitted. The mother would be held in contempt of court for the breach and could potentially, face a fine, hours of unpaid work or in more serious incidents, imprisonment. That will be at the discretion of the judge on the day of the hearing.
In my past experience few years ago, yes its back to court, which as you probably know takes time, money, stress & heartache.
I had penile notices attached to my orders & at 1 point an arrest warrant , but to be honest they sound more scary than what they are, after years of her not sticking to court orders i applied to have full residence of my son......
good luck bud
